As you have found out a solicitor is very expensive, and is what your ex-employer will have to pay to defend your case, which he will loose, and start his. With a small claim neither party can claim solicitor expenses unless its for a specialist advisor, but you can claim 10% interest on unpaid bills.Do you want your money back, and a bit more, search for 'money claim online' - They don't like it up 'em Captain Mainwaring0

Spoke to solicitor yesterday. They said will cost me a fortune to start communicating trough them and is not worth it for the money he owns me but how is this fair? I had worked hard for this money.
Welcome to being self employed. It is fair because you half-!!! running a business. A contract stating the extent of your liabilities would have saved you from all of these problems. However because I doubt you got them to sign a contract there is no end to what they can claim from you and without any payment terms they can take their own sweet time to pay you if they choose to pay you at all as you have not said when stuff has to be paid by.
If you do not want this kind of aggravation may I suggest two things:
1) Have a Terms of Business which you get clients to sign and, like I did, in that contract have a term that states you're not liable for any damage, costs or losses arising from the actions of you or any of your employees or representatives. It also would have a term stating payment terms and late payment penalties. I'm guessing you don't have any terms of business you get your customers to sign because if you had you would have just been able to wave the document in his face and tell him to go whistle.
2) If you're not prepared to run a business properly and don't want the hassle of having to cope with problems of non-paying customers then get a PAYE role.This is a system account and does not represent a real person. To contact the Forum Team email forumteam@moneysavingexpert.com0 -
