    Hi all just an update and quick question,

    Letter went off and no reply,

    She is due to start a new job on Monday, she did not have to give her previous employer as a reference on this, am I right in saying that her past employer cannot just make contact with her new ones to bad mouth her and mention the disciplinary?

    It would be a breach of GDPR to give out any personal information at all as she has not given consent for them to do this and they are a third party.

    As always that doesn't physically prevent them, it just means there could be consequences if they do.

    Thanks for the responses, they were what I thought

    And yes its pretty bad, what makes it worse is it is a charity who have patients under there supervision so boast about tight GDPR etc

    That could actually be helpful to your friend. A small business might not care about the reporting of a GDPR breach, a charity is going to have a lot more reasons to be worried.
