Smart parking ticket

Hi guys
I have received a smart parking notice
I have appealed with the template letter
To which as no surprised as been rejected
So it’s off to popla I go
My question is this was a car park I visited on a day out so I don’t have any recollection of signs terms etc etc
They have me going in and coming out on photo
I overstayed by less than 5 minutes
Will my claim be good to go on grace alone ?
Are will I need to travel back to the car park to look for further evidence to support my case

    they have the vehicle going in and out , not YOU

    the DRIVER overstayed (do not use the words , "MY , ME , MYSELF & I")

    the BPA CoP clause #13 covers 2 grace periods , please download it and read it (January 2018 edition)

    try GSV for signage images

    appeal on

    GRACE PERIODS
    POOR AND INADEQUATE SIGNAGE
    NO LANDOWNER CONTRACT
    POFA 2012

    etc

    as much as possible, not one single point

    Actually I am surprised. Smart fold when they see the FORUM template.

    Which template did you use and did you not imply who was driving?

    Read what Pete Wishert MP said recently about these scammers in the House of Commons

    "I am sick and tired of receiving emails from people complaining about the behaviour of parking companies, telling me that they will never again visit Perth city centre because of the negative experience they had when they had the misfortune to end up in a car park operated by one of these companies. I have received more complaints about one car park in the city of Perth than about any other issue. That car park is operated by the lone ranger of the parking cowboys: the hated and appalling Smart Parking—I see that many other Members are unfortunate enough to have Smart Parking operating in their constituencies. It has reached the stage where one member of my staff now spends a good part of each day just helping my constituents and visitors to my constituency to navigate the appeals process.

    The BPA does not have the ability to regulate these companies and has shown no sign whatsoever that it is trying to get on top of some of the sharper practices. The BPA gives a veneer of legitimacy to some of the more outlandish rogue operators by including them in their membership, allowing them to continue to operate. The Bill will oblige operators such as Smart Parking to amend their practices."

    Parliament is well aware of the MO of these private parking companies, and on 15th March 2019 a Bill was enacted to curb the excesses of these shysters. Codes of Practice are being drawn up, an independent appeals service will be set up, and access to the DVLA's date base more rigorously policed, and persistent offenders denied access. Hopefully life will become impossible for the worst of these scammers.

    Until this is done you should still complain to your MP, citing the new legislation.

    Just as the clampers were finally closed down, so hopefully will many of these Private Parking Companies.
    You never know how far you can go until you go too far.

    Probably the wrong one
    But no
    I decline your invitation to name the driver which is not required of me as the keeper of the vehicle . I will not be paying your demand for payment for the following reasons
    I used the charge is disproportionate nd not commercially justifiable

    After reading thru lots of lines before and afterwards I understand that I have more than likely messed up
    But what I wrote in appeal to smart doesn’t mean I can’t add more when appealing to popla , or does it ??

    The initial appeal becomes irrelevant now, as long as the identity of the driver wasn't revealed.

    You are free to go to town on a POPLA appeal.

    I have read the newby thread over and over Olso lots of the popla results as well as other posts
    Just can’t find what’s probably right in front of my nose

    I am on phone and don’t have #12345etc
    But I have now found what you referred to
    Only I don’t see the grace one
    Which for less than a 5 minute overstay I’m going to make as my 1st point of appeal
    Followed by driver
    Then signage
    Finally landowner
    Would you agree on the order ? Or does it make little difference
    I have read in some popla results were upon granting appeal they don’t bother to go thru the rest of the points once one is good enough to win

    Certainly lead with your strongest point.

    You should be able to find Grace Periods in the Newbies' thread. But can you get hold of a laptop or PC? You will not be able to access this site easily on a phone.

    look at other recent popla appeals where grace periods is mentioned

    its also mentioned in the BPA CoP , January 2018 edition

    stop using a phone and use a laptop or desktop pc , its much easier

    a phone does NOT give you full internet capability , a laptop does

    use the order I gave you , with a bullet point menu, the assessor can choose what they want to read then (like a recipe book)
