Delays in the litigation process are commonplace and the fact that it has dragged on for four years is no indication of the amount of work that has gone into it. It would certainly appear that the work was neither particularly thorough or diligent if the legal team have only just spotted a weakness in the case that was discoverable from the documentation that the OP claims to have given them early on in the process.0 -

Yes, it is ATE insurance.
It is usually compulsory. It is almost always taken out for "no win no fee" personal injury cases.
Otherwise the case would not really be "NWNF" due to the risk of having to pay the Defendant's costs if the claim is unsuccessful.0
