31.3.130 Establishing the beneficial interest in a property – starting position

Unless there is an express declaration of trust providing otherwise [note 19] (see paragraph 31.3.135) the presumption is that beneficial interest will follow legal title.

The first thing is to try not to worry. I have been bankrupt myself, this will get me no votes from IP's but I don't care. They are basically lazy and will shout a lot - in letters to scare you.They won't be getting paid much from your case = they won't work too hard.

However, they only go for the easy picking. Your husband's house is not easy. However, you offer something they will take it !!

Believe me, the house is safe. The IP or official receiver (OR) won't be interested,
