Hi Again
have posted earlier regarding my husbands debt 0f £10500 We received the letter from capquest today but after searching the forums I am even more worried! The letter states that they have power of attorney:Royal bank of Scotland plc...can anyone explain what this means and should the bank of Scotland not have contacted us first to ask for the money?

Also what is a cca? thankyou:confused:

    Sorry, can't help you with the first part of your question, but I thought I'd bump this up a bit.
    I can tell you that a cca, is a consumer credit agreement, the agreement that you signed when you took out the finance.

    Hi can you provide us with a bit more info? How old is the debt? What's it for etc? Are you admiting you own the debt? I take the debt does belong to your husband?

    Thats a strange thing to claim, I can only think that some clever clogs is trying to use this when they really mean "we bought this debt...."

  • power of attorney means control of your finances .... i think it may mean that they can access your bank account at their discretion, rather than needing your permission

    i have credit cards with the same bank that i have my main current account with ... if i didn't pay my credit card bills for a few months, i think the bank can take control of my current account using power of attorney

    there's lots of useful help on these forums so don't panic, you should be able to sort something out, the main thing is to take action

    The loan was taken out Dec 2000 and extended early 2001 to pay off various store cards etc. during my husbands first marriage. The debt was both of theirs but all in his name and she left him to sort it out...stupidly he agreed to do so and as such is liable for the lot. He paid it until 2002 when due to the CSA and maintenance payments he couldn't afford to do so. They never contacted him when he stopped paying, the last correspondance from them was Feb 2002 as far as we can find.

    Since 2003 he has paid off three other much smaller debts and we thought that as it was almost feb 2008 we had been lucky...although as mentioned in another post as the agreement was made in Scotland then instead of six years it might only be five years that there needs to have been no correspondence? Hope this further info helps

    ummmmmmm, I have Power Of Attorney for my FIL. When I need to use it (mainly with banks etc) I have to produce a copy of the original POA, together with 3 proofs of my ID. They then have to send it away to be scrutinised & registered before they will even entertain the idea of talking to me.

    I suggest you ask them to do the same.:p
