Default issued - now what (update)

I posted this a few days ago and people said not to worry as its normal and the agency normally accepts your reduced payments.

However my partner rang the debt company who wanted £50 payment by the end of the mth or baliffs would be on the door. The £50 = the total min payments difference for the last 3mths.

My partner just wants to pay it, but i know from asking payplan before they say not to, you've shown in your expenditure what you can afford and ultimately if we pay the £50 thats £50 i have to pull from some where else, so we'd struggle.

Problem is we've only just sent back our paper work to payplan for them to act for us so it might not all be set up in time for them to deal with this debt company. This debt company do not care where in contact with payplan as because they have no letters from them, nothing they can do.

Im really worried :confused:

    I think your problem is you are ringing them allowing them to put pressure on you.

    They cannot send baliffs round without going through the courts and that takes a lot longer than a week!

    If you are letting Payplan deal with things then you must let them do what you trust them too. Write to the company and say Payplan are dealing.

    If you are getting phone calls there is a letter you can send requesting everything in writing. To be honest I found it easier to just change my phone number.
  • Thanks for that. I thought we were doing the right thing rininging them and letting them know what was happening, that we were in talks with payplan. I thought ignoring the letter might make worse things happen.

    Definately keep in contact but by letter - over the phone they are paid to bully you and pile the pressure on, also they could say things that are not true and its your word against theres, they are less likely to do this in mail form and if they do you have proof!

    I guess what I am saying is please don't worry this is early days and the default honestly is just part of the process. But baliffs cannot come out of the blue there are processes to do before it gets to that. I am over a year down the line in my DMP - I run it myself so no big name to back me up and not had a visit yet!
