The letter we use is specifically worded so as not to acknowledge the account in question.
Send it off, let us know the response.
Thank you Sourcrates its very much appreciated0 -

Hi Sourcrates, I wanted to update this thread.
I sent the letter off via recorded delivery and it was signed for on the 08/05/19.
I have had no response from the DCA or even an acknowledgement.
Is this normal practice or is there a time frame for a reply ?
Many thanks0 -

They may not reply, they will have to go back to the original creditor for the account information, give it a few weeks, then if still no response, send a follow up reminder letter.I’m a Forum Ambassador and I support the Forum Team on the Debt free wannabe, Credit file and ratings, and Bankruptcy and living with it boards. Good day @Sourcrates
Small update regarding this thread I recieved a reply letter from Robinson way roughly 3 weeks ago stating that "my account was temporarily on hold and untill they can investigate the matter".
Funny how they wrote my account was on hold when I was disputing the account in the first place.
Should I fire a letter back stating that I was disputing this fact or just ignore it.
Is there a follow up letter for this or should I let it lie now.
In my orignal prove it letter I stated that they had to remove the default if no such proof was available.
What sort of time frame should I allow them.
Many thanks0 -
The ball is now in their court, it may take some time to try to obtain the correct paperwork, so it becomes a waiting game, the debt remains unenforceable until they do respond to you correctly.
It may take a good few months, so be patient.
A complaint about default removal, should be considered only if they cannot provide what you have asked for.I’m a Forum Ambassador and I support the Forum Team on the Debt free wannabe, Credit file and ratings, and Bankruptcy and living with it boards. Hi Sourcrates, Im just updating this thread as I believe it will help others.
Today I recieved a letter. We received contact from you where you raised a dispute with us in respect to the above named account.
We would now like to confirm the following details we have for you which we hope resolves your dispute.
*your account was passed to Hoist finance on xxxxxx
*your default date is xxxxxx
*Your current outstanding balance is xxxxx
*Your account was opened on xxxxxx
As we have not been able to provide all details specific to your dispute we have marked your account as unenforcable, meaning we will not pursue any legal action, and informed our client to remove an reporting on your credit file, this will be actioned in 30 to 40 days.
The above account remains outstanding, and we want to to work with you to agree an affordable arrange, ent based on your individual circumstances. Remember that making regular payments towards your account means that:
*blah blah blah
*blah blah blah
In order to move forward with your account we require you to call us.
At this moment we maybe able to offer you a discount
We have held your account for 14 days to allow you time to do this, after which collections activity will resume. If you have any further questions in regards to your dispute please contact us, as soon as possible. We now consider your dispute closed.
They have produced no paperwork to back up the above balance, default etc.
This letter is seriosuly wrong in my eyes:
I have asked them to prove it (they cannot)
They want to continue trying to collect the debt even though they can't prove anything (wrong on so many levels)
How can I shut them down permentaly Sourcrates going forward.
Thanks for all your help too.0 -
Well basically there is nothing they can do, you could try sending a letter making your position crystal clear, chances are they will sell on the debt, and it will be rinse and repeat with someone else.
Keep the correspondence from them just in case, put it to the bottom of the pile and concentrate your efforts on the debts that are enforceable.I’m a Forum Ambassador and I support the Forum Team on the Debt free wannabe, Credit file and ratings, and Bankruptcy and living with it boards.
