Hi all,
Letters, texts and calls from Lowell Financial for a disputed bill from Talk Talk in Nov 2015. At the time my contract had expired and I gave 1 month notice on the recorded call and moved out. Talk Talk continued to send bills, I complained and they only called me when I was at work, when i had asked them to call at specific times. They then said the case was closed and passed on as they couldn't contact me. Lowell began contact: calls and letters, ignored until after advice here I sent 1st PROVIT letter, this is Lowell Solicitors response:
"We are instructed on behalf of Lowell Portfolio to recover the outstanding balance to an account you opened with TalkTalk on 21/11/13. The last payment made to the original creditor was on 01/12/15 for £37.70. The phone number that relates to the account is XXXXXXXX and the balance in question is now legally payable to our client.
Please be advised that we do not regard our attempts to contact you as harassment. We have been instructed by our client with respect to your account and you are under obligation as per the Court rules to keep you informed of the progress of your avccount and inform you of any consequences of non-payment
We note that you quoted chapter 7 of the Consumer Credit Sourcebook however you have not provided us with further information in relation to this. To enable us top raise the matter with the original creditor, please provide us with sufficient evidence, including any relevant documents or proof to support the reasons for your dispute"
Here's my problem: the landlord of the property has sold up and moved on I don't have his details. I have nothing to "prove" I moved out apart from the fact I could get an affidavit from my housemate and one from my next landlord. I asked Talk Talk to check my account and they will see the drop in activity from busy to zero on the dates I gave them, plus I asked them to check the recorded phone call.
What advice do you have here please? Thank you in advance

Why are you sending prove it letters for debts that you know are yours...Know what you don't0

If you were out of contract, and you gave 30 days notice, then there should be no debt to answer for.
Unless there was an outstanding bill ??
You should put your reasons in writing to Lowell, as soon as possible, tell them you belive no debt exists because you cancelled your contract, the onus is on them to prove there is a colletable balance, not for you to prove there isnt.I’m a Forum Ambassador and I support the Forum Team on the Debt free wannabe, Credit file and ratings, and Bankruptcy and living with it boards. Hi Mike, I have tried on Facebook as no Twitter and I am sorry tp report, the service there is as bad as it was when I left (and a reason why I left)
I just want the hounding to end. I gave notice, I was out of contract. The most they could want is 1 month's service, yet bill me £220!
Please sort it out Mike, I have tried on Messenger and they just don't get it0 -
Have you put it in writing to Lowell that you cancelled the contract and gave them notice via the recorded call?
Have you made a written complaint to TalkTalk via Royal Mail? If you use the official written complaints process then you will be able to escalate to [STRIKE]OFGEM[/STRIKE] OFCOM should the matter become deadlocked or unresolved. Facebook and Twitter are not good routes to resolve this type of complaint.
Have you checked if the account has been recorded as defaulted on any of your three credit files?I work within the voluntary sector, supporting vulnerable people to rebuild their lives.
I love my job0
