FORMAL NOTICE IS HERBY GIVEN THAT OUR CLIANTS HAVE INSTRUCTED US TO COMMENCE COURT PROCEEDINGS AGAINST YOU WITHOUT DELAY. wHEN THE COURT ORDER IS AWARDED YOU WILL BE LIABLE FOR OUR AWARDED COSTS AND EXPENCES.
OK fine Blair, Oliver and Scott Limited (debt collectors not solicitors). The part I don't understand is the write with a proposal of repayment enclosing the first payment. We've been paying the same arrangement for years never missed a payment and they have a full SOA.

Blair Oliver and Scott are the in-house debt collection software for Halifax (Bank Of Scotland). This is generally just a 'scare tactic' that HBOS use to 'frighten' debtors into making payments that they can ill afford.
In the unlikely event that BOS were to initiate legal proceedings against your DH, a Court would see that, by making regular payments, he is being serious about his debts and would be most unlikely to order him to pay any more than he/you can afford.
Another point about a Court Order is that the Courts tend to bend over backwards to ensure that the 'debtor' is treated fairly and they could issue an order that actually decreases the amount that you are currently paying - BOS would be just as bound, as your DH, by any such order - and they don't like that.
I would 'let' them commence proceedings, but I don't think they will.I am NOT, nor do I profess to be, a Qualified Debt Adviser. I have made MANY mistakes and have OFTEN been the unwitting victim of the the shamefull tactics of the Financial Industry.
If any of my experiences, or the knowledge that I have gained from those experiences, can help anyone who finds themselves in similar circumstances, then my experiences have not been in vain.
