Occupiers consent and postponement deed.

We got our first house 8 years ago, as I wasn’t going on the mortgage I had to sign this form. My husband told me he would add me in a couple of years, once I had more accounts, I had just gone self employed.
He’s never added me on to the mortgage.
Things are not good between us, and we are due to split up. We have 3 young children. What I want to know will this form I signed stop me getting half the house, as he wouldn’t be able to afford the house without me, so he would have to sell it. Hope someone can help me.

    It's a consent to the mortgage i.e. so you can't object to the lender kicking you out if they wanted to repossess. Nothing to do with your matrimonial rights against your husband.
  • If he thinks not putting you on the mortgage is going to put him in strong position, he is very wrong! See a solicitor, but aim to wrap up things quickly and amicably.
