I have had a letter that clearly states that PRA have currently deemed the debt as in enforceable which means we are not able to take court of further enforcement action against you to recover the debt.

However the paragraph after says the debt has not been written off !!. They can still legally contact me and ask for repayment.pass my details on to a third party collector or continue to report my account with credit reference agency,

So what does this all mean ?????? :eek:

    It means exactly what it says.

    For a consumer credit act debt to be legally enforceable, the creditor must hold a valid credit agreement.

    The debt is unenforceable, presumably because they cannot provide a valid credit agreement, they can still ask you to pay, they can still report on your credit file, what they can’t do is take you to court to enforce their rights, as the without the agreement, they have no rights.

    So What are your intentions now ?

  • I dong know really. Would like some advice. My immediate reaction is to tell them to write the debt off and not to bring it up again. Is this too much to ask ?

    What I suggest you do is tell them that you have other debts of higher priority and you will be concentrating on them.

    Usually if you do this, they will go quiet.

    They won’t write the debt off, most likely it will remain a dormant account, or you may have to fend off future collection attempts by different debt collectors.

    Sending a copy of the Cabot letter will normally be sufficient to send them packing, so keep it very safe.

  • I also had bad mental health problems for which I see a counsellor and a GP and am on a list of medication.
    Is it worth mentioning that ??
  • I have also been to to send CCA templates to them. Where can I find a template ?

    They have already admitted they have no CCA, that’s what your whole post is about. So sending a further request would be a pointless exercise wouldn’t it.

    If the constant letters or the threat of constant letters are of a concern, and may affect your mental health, then send a letter as described by FB above.
    What I suggest you do is tell them that you have other debts of higher priority and you will be concentrating on them.
    Unlike some here, I am not omniscient. If I am wrong correct me. I won't take offence.

    I wouldn't do this at this point, you don't need to pay anything for it and because of that it's none of their business. Do as above posters have said. Until (and if) they can produce a valid CCA you have no legal obligation to pay.

    Keep the letter confirming there not being a CCA and if you get letters from any other debt collector don't fret simply say "no valid CCA, no money due". If it helps you think about it that in effect these companies are paying to send you letters to chase up a debt they cannot actually collect on, they are as effective as a toothless piranha in a shark pool. If they ring you up ask that they write to you. Please don't ignore but don't worry about it.

  • If I have other debt can I write to them ask ask for CCA and get that debt in the same category as this one ?
