Hi Everyone
Wondering if anyone has any experience of reclaiming their 3% second property stamp duty land tax having sold their original home following purchase of their new one?
Working on such a case with Clients and looking to get a feel for the timing and mechanics of a Second Property SDLT reclaim to assist them in working out cash-flow.

There is some information from HMRC here https://www.gov.uk/government/publications/stamp-duty-land-tax-apply-for-a-repayment-of-the-higher-rates-for-additional-properties about the procedure for reclaiming the extra 3% once the original home is sold / disposed of. I understand that it is taking about 3 - 5 weeks for HMRC to process refunds, but others may have more up to date experience.0

I posted my refund claim form, and according to the Gov.website safe in the knowledge that my claim would be dealt with in 15 working days. How naive!! After many phone calls to the helpline
a letter of complaint and 67 working days I finally received my cheque. I think 3 months is a more realistic time frame for a refund to be processed. The department dealing with SDLT refunds are understaffed and dealing with thousands of enquires. Don't be disheartened keep phoning and writing and complaining about this stupid tax.0
