Seems as if the answer to an extent lies with the people who make wills. I'm changing mine next month (for a few minor updates) and I'm going to ensure it says the house is sold rather than i leave the house to kids which i have a feeling it currently does (I'm not going rummaging around to see what it does say as I'll be looking in a few weeks anyway. If that was clear in peoples wills from the get go then these situations would not arise.
Hmmm..... here's a Q for the OP, what did the will say? If it directed the house should be sold but you just didnt enact that then perhaps your brother has no leg to stand on in terms of legal challenge ?0 -
How old is your brother. Would he be old enough to raise money to buy you out via lifetime/equity release mortgage?0
