Sale of goods advice

Hi All,

Just wondered if anyone could offer any advice.

Earlier this year I bought a digital camera. As I used it I found that I kept getting numerous pixels that always showed as black or white. Unfortunately, because of the type of shots I was taking and the noise reduction system of the camera, they weren't apparent in every shot and it took a while for me to become sure that they were actually a product of the camera rather than anything else.

I got back in touch with the retailer just within six months of the purchase date, explained the problem and they told me I would have to return the camera, which would then be sent to the manufacturer for assessment. They (the retailer), would then offer repair or partial refund (as the camera was beyond the 28 day full refund period).

The camera was and is being used to document an ongoing project and I am only now, 3 months later, able to return the camera. I have spoken to the retailer again and they have again reiterated the same policy. Unfortunately, it could take anything from two to six weeks for the manufacturer to deal with the camera and I absolutely have to have a camera within 3 weeks to continue the project.

The camera is well inside its two year guarantee and the problem definitely existed at the time of purchase. Do I have to accept a partial refund or could I ask for a full refund bearing in mind the existence of the problem at the time of purchase and subsequent notification within six months?

Any advice gratefully received :-)

    If the goods are faulty, you are entilted to a replacement or it to be fixed.  If you notice within 6 months of puchase it is up to the retailer to prove the goods are faulty, if it is after 6 months it is up to you to prove the goods are faulty.

    The retailer should pay the cost of fixing the camera, offer a replacement or may offer you a refund.  The retailer doesn't have to offer you the refund BTW, but does have to pay to fix the camera.
