Barclays Partner Finance

Hi all,

I'm new to the forum and was hoping someone could please give me some advice to help me with Barclays Partner Finance (BPF)

I returned a car at the voluntary termination point, as I had repaid 50% of the agreed payments (£328 per month), on 21st February 2019. I received a letter from BPF before this date to confirm that no payment was due for the voluntary termination. I was advised not to cancel the direct debit until the car was returned, however I forgot to cancel it and a payment was taken out of my bank on 28th February, AFTER I had returned the car.

When I contact BPF, I was advised that the payment was not needed and that I should ask my bank to do a direct debit indemnity so that the payment could be returned to my bank - this was done in a matter of days and my understand was that my agreement had come to an end.

I was sorely mistaken...

I heard nothing from BPF until 25th March, which was a text message to say that my account was in arrears and I needed to contact them and make payment. I contacted them on the same day and explained the advice I was given and that I had already returned the car, it was at this point they told me that the balance outstanding was £1570!

Apparently, the total cost included the monthly payment of £328 and the condition charge, for repairs to the vehicle after it had been returned - the car passed an MOT just two days before it was returned and was in good condition, I even took photos of the car in case they tried to do this.

At this point, and even to this day, I have still received no breakdown of the £1570 from BPF so I have no idea what the amount is for.

I spoke to BPF earlier this week to ask for the breakdown again, as it had still not come through, and I was told that the account was now two months in arrears because we've fallen in to another month while I wait for the breakdown of costs!

I raised a complaint with BPF on 25th March about the condition charge as I am disputing the cost of repair and the repairs themselves, however I am yet to hear back from them to acknowledge my complaint - I was told on 25th March that they would be in touch with within 4 working days or send me a letter on the 5th working day, and I've still not heard anything.

My first concern is my credit, as it's extremely good with no missed payment, defaults or CCJs, yet there's a real chance that BPF have reported my two "missed" payments to the credit agencies, this I feel is extremely unfair.

When I spoke to BPF today, they told me that if the car didn't have any condition charges then I wouldn't have had to keep paying the monthly payments, however because it did have a condition charge (balance) that I was "obliged" to keep paying the monthly payments until the full balance was paid off? I asked for their terms to say this and I was told that it wouldn't be in the terms I signed for?

BPF told me today that if the complaint goes in my favour, they may be able to do something about the two missed payments to date, however they recommended that I paid the £328 at the end of April and said their complaints team have FORTY days to respond, which would take me in to May's payment!

When I have had cars in similar ways before, there has been a repair cost at the end but that was it! They did not expect me to keep paying the monthly payments after the car was returned - not only has it been returned, but they've sold it and they still expect me to keep to those payments!

If BPF had informed me of the condition charge in reasonable time, and their advisor didn't recommend I had the payment returned to me, then I would have been able to make payment on time for the condition charge, however they have dragged it on so much and not given me the information I need and expect me to simply pay £1570 without telling me what for.

Please can someone advise me on the best course of action to stop this impacting my credit? If they have reported me as missing two payments, is there a way for them to reverse that on my file? I feel this is extremely unfair and having looked in to BPF today it seems many people have had issues with them in the past with lots of very bad reviews!

Many thanks in advance!

Rafa

Can't give you advice on the issue itself, but I CAN advise you to write shorter posts. Most people won't read such long posts, and if they need more details to advise they would ask for it.

50% of payments made is not the same as 50% of total loan including interest to date?
IMO they have a case to pursue you for the amount outstanding as you have written your post.

    Hi,

This paragraph just about sums it up for me, and coincidently blows their argument completly out of the water, and shows what an utter shambles BPF really are.

Once you have signed an agreement, it becomes legally binding, any adjustments to that agreement, must be notified, and accepted, in writing, by both parties, now that is extreamly rare, normally you just sign, agree to the terms, and thats it.

They are currently holding you to a term, they say, was not even in your original agreement, and that consequently you have never agreed too.......work that one out, you cannot just say, oh you are oblighed to keep paying under certain circumstances, its not in the terms you signed up to, but you must pay us anyway.

They are talking utter and complete rubbish, and its a reminder of a very similar experiance to my own with BPF, differant senario, same incompetance.

OP, I would run this past the FOS helpline, i certainly would not pay them any more money until i had clarification as to why i had to keep paying even after the car was returned and sold on.

And to say you are bound by a term in your contract that was not even there, well.........words fail me.
