    The OP may have bought the house and let her brother live in it but that would mean their circumstances were very different to now earning £23.5k

    it is not uncommon for people to think they own a property,like when they inherit 1/2 a house from a parent but there is a life interest for the spouse meaning they don't own it.

    I wonder if something similar may have happened here the OP inherited the house but there is a right for the brother to live there.

    Good point. I'm not sure if there are exemptions from the extra 3% in those sort of cases?

    There are, that's why I have brought it up.

    The key is beneficial interest not legal interest.

    I own the house 100% from a divorce settlement. Nothing to say my brother has to live there, that is my choice

    Then back to square one, extra 3% SDLT is liable.
