please please help repossession

Hi long story Trying to be short. But please help

My husband died nearly 2 years ago. The mortgage is in his name. I havent had the money to transfer over to me. I do work.

In january last year the house was repossessed. I went to court and an agreement was made where i would pay so much off the arrears.

This year I have struggled, and missed payment and arrears.

I have recieved a letter today telling me my arrears are 914.00 and they are enforcing the court order that was made against me on 09/01/2006.

I have managed through family to get the 914.00 can they still evict us. I have a young boy. Its all very hard on him as well

Please any advice

  • You state that the house was repossessed in January 2006 - so where are you living at the moment? Does the letter received today give any details of when/how you must pay off the £914 arrears?

I suspect that a suspended repossession order was issued, and an arrangement was made with the court that she would pay a set amount per month including an element towards repaying the arrears. As long as the agreement is adhered to then the repossession is suspended, if the agreement is broken then the lender can take move for possession.

Is the £914 arrears the total amount of arrears on the mortgage? Or is it the amount you are behind on the arrangement that you made originally with the court? I suspect if you pay the full arrears off then you should be fine, if its the latter then it will be down to the lender and how they wish to proceed.

You could speak to the Citizens Advice Bureau if you need extra assistance.
