  • They won 't take anymore than is owned can't see how they could or would. If i won a million tomorrow i'd be straight on the phone get it all paid off and get on with my life happy days!!! :)
  • hi michelle when i was asking about wills and windfuls i was told they can if they want claim all of it as by going BR you are givin the OR everything you own but he is letting you have what you need to live on so i was advised IF you was to come into a large amount of money then the best thing would be to annull your BR/fast track iva preferbly before the OR passes your case to a trustee as they add thousands on top for their fees thats why if you are in a will its best to get it change just while you are BR

    Along the same lines but not winning any money . If i were to be declared bankrupt what would happen to any money i receive under an equal pay dispute i have going on with my work (local council). At the moment it is in the hands of a lawyer but could take a year maybe more to be settled. Would i have to pay it to the bankruptcy or would i be allowed to keep it as it is basically back pay?

    Not good news, I'm afraid - you WILL need to inform the OR of the situation as it is something that started prior to your bankruptcy.
    The decision as to what will happen in the case of any payout will be that of the OR/Trustee.

    Could well be, subject to the nature of the claim, that you might have a case for keeping at least part of any 'payout', ab.

    There was a case, a few years ago, where the wife of a bankrupt won several million pounds on the lottery. I can't remember the exact case, but I do recall that the Insolvency Service did try to claim that the cash was his - and therefore due to the OR.
    All I do remember is that their claim was not upheld.
