Moriarty Law is chasing me for a debt from 2012

Hello,

I have received a letter from Mortiary Law and that they represent JC International Acquisition. The originator is Talk Talk Limited.

Back story: I have previously used TT, maybe 2-3 years ago and I have closed my account and paid everything in full. However, back just when I closed my account with them, I still kept on receiving letters from TT to pay my outstanding balance, to which I did. Yet, I still received letters from them, so I called them and they told me to ignore those letters.

Back to the present, I now have to deal with them again, but through Mortiary. I have no contacts with TT and I don't use their services and haven't used them in years. Now I am being sued for £350 dating back from 2012. I ignored those letters, but now that I received a County Court order, I think its a serious deal.

Here's how the Order goes:

Particulars of Claim
The claimants claim is for the balance due under an agreement with Talk Talk limited dated 12/05/2012 which was assigned to the claimant on 31/03/2015 and notice of which was given to the defendant on the 31/03/2015.(was not) and which is now all due and payable. The defendant agreed(I did not) to pay monthly instalments under account number ******** but has failed to do so and the claimant claims the sum of ££££. The claimant also claims interest thereon pursuant to S.69 County court act 1984 LIMITED to one year to the date hereof at the rate of 8% per annum.

The issue date was 2018 Oct, but nothing yet has happened.

Any suggestions would help a lot as I am very lost with the legalities, thank you!

    Well that letter looks like a letter before action (LTA) to me, have you asked them to provide you with evidence of the debt ?

    Are you sure a CCJ by default has not been awarded against you ?

    Unusual for them to wait this long after a LBA.

  • Should I ask proof of claim from the County Court or from the claimant?

    I've spoken with TalkTalk today, and they told me that my "debt" has been sold. But they could not provide any information as to what debt. I have paid everything and had no problems paying for the services.

    I have checked online with the Court that it's being issued: County Court Business Centre in Northampton. It all seems like a scam, but I still can't ignore these documents in case it's an actual legal matter.

    No it’s not a scam, JCI are a well know player in the debt purchasing industry, you ask them for proof, not the court, but only if a judgement has not yet been granted, if it has, its too late.

    I’m a little unsure how far through the process you actually are to be honest.

    That's clearly a claim form, not a court order or a LBA.

    What should have happened is that Moriarty should have asked for summary judgement and you should have been sent the court judgement, which would usually be a 'judgement in default' ordering you to may the whole amount 'forthwith.'

    There is no harm in asking the court where you are with this (not sure what you mean by 'checked online' - have you emailed them?); equally you could check the register but it will cost you £6.

    Don't do a search through credit reference agencies at the moment. Would it be true to say that you haven't done one in the past few years?

    Likewise I wouldn't contact the claimant (JCI, not Lowell for once, Sourcrates) for the moment.

    There's something causing a hold-up in the normal process here and I wouldn't want to dislodge it. It could be because the claimant has given a US address. Or they're uncertain whether to spend more money on this.

    Edit: it could just be that they have done the bare minimum to stop it going statute barred. That would make some sense.

    LBA`s occasionally get sent out that resemble claim forms, and lowell have been everywere this last week.

    And i`m easily confused. (edited to correct name, thanks FB).

    Moriarty Law tried to take a CCJ out on me in 2017 over an old Pay Day loan debt from 2011. So if I was you I would act on it to make sure they don't as they don't mess about when it comes to CCJ.
