Notice Period

I’m unsure if I have put this is the right section, apologies if so.

My partner handed his notice in today, he has worked at his current employment for 7 years and has to provide 4 weeks notice. He is going to join another business in the same field. The director of his work was not in today so he handed his notice into the Operations Director she advised my partner that he would probably be asked to leave straight away and was asked to return to the office whilst she rang the director. She shortly came back and said he was to leave immediately. We are now concerned if he is on some sort of gardening leave or if he will get paid. His work have provided nothing in writing and are not speaking to him. His new job has asked him to start work tomorrow but he is not sure where he stands legally, and also if he is entitled to notice pay in lieu? Will he be taxed for two jobs?

  • If he ends up being paid by both employers then yes he would (and should) have to pay tax on both lots of income.

    He really needs to find out more what is happening with the old company.

    What tax code is he on with the old company?

    Given your user name it would not be unusual to be asked to leave immediately if work is of a "sensitive" nature.
    Naturally he is nonetheless fully entitled to his paid notice period therefore by the sounds of it he most certainly will be taxed on his "double" income


    when he starts the new job he will not have a P45 to give them so the new employer will put him on the often miss called "emergency" tax code. That will sort itself out next month when he gets his P45 from his old employer and his new employer reacts to it.
