Follow up after CCA

Hi, we sent CCA requests around two months ago. We waited and heard nothing then followed up with settlement offers. Not had anything back from either letter. I know it can take months but I’m wanting to follow up. Does anyone have an email address for this kind of query for Capquest or Link? We did have some docs through from PRA but we also sent a settlement offer to them and heard nothing.

Don’t want to leave it and wait too much longer as each month we’re paying £456 across the debts and I’d rather settle than start messing about stopping the dmp payments and having to self manage each one. This will be our next move but I’d like to email them first to prompt them. Letters take too long and don’t really want to call.

    Hi Gillian,


    You say you are still paying the debts yes, although the company concerned is supposed to provide a response to you within 12 days, debt collectors, especially if your paying them, have no real incentive to fulfil there obligations to you.


    And sending settlement offers before they have complied with your request was a big mistake, and has likley confused the situation.


    Once you make a sec 77/79 request, the debt concerned becomes unenforcable in court until the creditor sends you what they are supposed to send you, all payments should have ceased to these accounts for the time being.


    Your accounts are currently unenforcable, and will remain that way until PRA group send you compliant copies of your credit agreements, save your money.

    I think I just want to get these paid off of why we’re trying to rush things!
    We waited two months and heard nothing so our response was ‘we’ve not heard from you, you haven’t replied to our request therefore it is currently unenforceable. So here’s an offer of (low amount) or else we’ll stop paying basically!
    I anticipated they’d come back with either the cca info or a counter offer.

    I sent CCA requests to Link and PRA around July in 2017 and it took both of these companies more than 6 months to respond - so its still really early stages for you. Link never even acknowledged they'd received the request, but PRA did and to their credit they kept in touch with letters stating that they were still investigating blah...blah. The Link owned ones proved to be enforceable, but the PRA ones are UE.

    During that time I didn't pay either of them a penny and took control of my DMP (from SC) and have remained self-managing ever since. Roll on 18 months or so and I'm still not paying PRA anything and they are still not offering great discounts - so what I mean by this is this is a long game and there's no point rushing.

    If I were you I'd stop paying anything until you get their formal responses - with paperwork or not and put that money aside for the F&Fs you are keen to make.
  • Thank you. Yes it does look like we’ll have a choice to make. If we let our dmp roll we’ll have finished paying it in less than 2yrs. If we stop paying it’s likely to drag on but might end up paying less. For us we’re keen to get out of debt and move on the next things we want to save for. I guess if we stop paying we can bank that money and hopefully be able to settle for lower and save the rest down the line.
  • Although I do wish in hindsight we’d not gone down the CCA route. It’s been so stressful and I literally find myself waiting for the postman in hope he’ll bring response letters. I guess when it comes to debt and mental health it’s a balance betweeen what’s saving the most money and what’s the least stressful.
