Can I include a small claims debt in my bankruptcy.

Guys I’m in the process of going bankrupt but have just received a n1 form from someone claiming £6000 from me. Question is I haven’t got the money anyway hence the bankruptcy I’m just wondering is better admitting it as it is a legitimate debt against me and once it’s done can I then include that in the bankruptcy aswel as I will hold off completing if I can. Thanks in advance

If you're banking it doesn't matter if you admit it or not, the end result is the same. All debts and assets up to and including the day you're declared become the property and responsibility of the official receiver. Anything that crops up after you've banked that was a debt accrued from before you banked you give the contact details of the OR and tell them to deal with the OR as you legally cannot.

Any debt (except for court fines, student loans, child maintenance payments and debts incurred through fraud) that was incurred prior to the bankruptcy order is written off. So just add it to your application.
