Annual DBS Check

My employer has a contract with a foreign organisation which have new stringent rules around their national security.

As part of a proposal from my employer to the organisation, they have suggested all employees undergo an Annual DBS Check (basic as far as I know).

I've read a bit of stuff on the gov.uk website, but it isn't clear to me whether what my employers have suggested is actually legal (or possible through the DBS).

Personally I have no problem undertaking the check, though this is not what I understood the DBS check to be for.

Any comments welcome.

    AFAIK this is legal.
  • Perfectly legal, if its a basic check than it shouldn't take long to come back to the employer if compared to say they were to ask for an enhanced check.

    Your DBS status could be checked every month (or more frequently). If they do want to do an annual check then it would definitely be worth signing up for the update service (which you have to do within a specified number of days of the certificate being issued). There's an annual fee but, armed with the certificate number and your name and dob, the employer can check whenever they like if you agree.

    So the only "legal" condition is that you agree to their check.

    Its legal if the employer is asking for a basic check.


    However if asking a person to apply for a standard or enhanced DBS check, the employer is legally responsible for making sure the job role is eligible.


    I do DBS checks for a charity - I have to give the legal grounds for each and every standard and enhanced check.
