10 mins wash up time.clocking in and out

Hi

Ive seen a couple of these but i need a law or an obligation or something abit more then yeah your work is allowed and its only 10 mins stop moaning.

So at end of shift we could leave our area ten minutes early to start walking to staff level wash hands get changed take radios back to office and maybe hand in some keys for example,

I start work at 5am finish at 1:30pm but now we are not allowed to leave our area of work until bang on 1:30am which is fine tbh but here is what my point is,j work in a large shopping center with loads of different areas each area is a different distance to the staff level shortest 3-5 mins longest 7-10 mins travel time but even tho its 1:30pm and I'm walking to staff level i still have to work Eg i see a bin full i need to empty it i see a spill on floor i have to clean it so on lets add an other 10 mins to my journey worse cause.I'm still traveling to staff area to end my shift get to staff level hand in keys radio go to lockers get changed back down stairs to clock out yes i pass the clocking in/out machine on the was but we can't clock out we go upstairs first to hand stuff in and to get changed then clock out.so now its around 2pm ish give or take a few mins.

What i want to know is this fair can i say anything is they any workers rights,laws i can go to my boss and say look i don't mind 5-10 but getting and extra 30mins outa us is abit much with out pay.in 10 days they have what an extra 5hrs of my time not paid that's £40 roughly on my wage that could be in my pocket

    Bit of a strange one and certainly worth speaking to ACAS etc. I suspect, however, that the key question will be "do you get paid at least National Minimum Wage?"


    Some thoughts from me:


    - Do you perhaps have a duty to clean up hazards even when OFF SHIFT but within the building (fairly common thing)? Could you not "turn a blind eye" to otherwise non hazardous issues en route?


    - They do pay you to work until 13:30 and so you should theoretically be available in your work area until this precise time.


    - It being a large shopping centre is, unfortunately, one of them. I used to work in a large retail store and had to walk from the tills to the staff room to clock out. I now have to walk from my desk to the other side of the building to catch the lift down and leave. Not sure you can count that as working time? Seems more apt to call it "commuting time" maybe?


    Certainly speak to the employer if you want, but you'd sort of have to gauge how they'll react. Some (but not many) would "mark your card" and make your life hell. Some (but not many) would pay you the extra 30mins worth. Most will take it on board and say they'll "review" the situation (usually never to be heard from again). Is it worth it?

    Yep. When I worked for Morrisons, I had to clock in three minutes early to be down on the shop floor for my work time. Couldn't leave the work area until exactly my time either. Got an extra 6 mins out of me every shift.

    Employment law would cover your query but don’t expect it to solve it. If you kick up a fuss, what action are you prepared to take. Do the overall benefits of the job outweigh the unhappiness over 10 minutes?

    Are you employed, self employed or a contractor. As an employee you could raise a grievance, the others would be contractual disputes. A union would be the natural route to resolve - will you all be happy to take collective action if needed?

    And don’t look to move into NHS, free work is completely the norm.

    Lets be clear, what your employer is doing is morally wrong, getting a half hours free work. It isn't like you could rock up a half late and get away with it.

    The problem is there is very little you can do about it, your employer can simply get rid of, especially if you have worked less than two years. Unless you are in a protected group and can show discrimination, UK employment law is pretty useless in practice.

    My advice is to find a better employer.

    I fthink the easiest way to solve this is by thinking that when you are 100% efficient in your working hours you can complain about a few minutes.

    I can almsot guarantee you lose them whatever you give them through non work related activity. If you can honestly say that you dont talk to anyone unless it works related, you dont take detours to do some window shopping, youve not been seconds or minutes late from your breaks or simply just stood there staring off in to space for a few moments then higlight it. Otherwise its almost certainly going to be a case of tit for tat.
