Halifax remortgage - Abbey saga

Hi all,
Have recently remortgage with Halifax and a very smooth process with them. Today finally resolved a problem which solely relates to Abbey and wondering if I have a valid complaint.
My settlement figure with Abbey was £91k and I spoke to them a month ago advising to place me on the standard variable rate. I spoke to the Halifax's appointed Solicitors who advised that the redemption figure was £95k+ :eek:
To my amazement Abbey had put me on a fixed deal along with the standard variable rate (is that possible!?) and hence I was liable for early repayment fees (over £4k). After making a complaint Abbey they deleted the fixed rate and all sorted.
After delaying my current mortgage application would I have a valid complaint? Any thoughts gratefully appreciated.
