Speeding in works van - not! who is liable?

Hubby works for local council printing, and most days makes deliveries of the stuff his department has produced. He has to deliver in a works van, which is maintained by another section of the council. He picks it up and drops it off, but it is serviced and repaired by this other department.

Last week, out delivering he was driving along a road where there is a speed camera. He knows this, and he often drives along there, and knows where the camera is (its fixed) so makes sure his speed is 30 on the nose! Anyway, he finds out that he has been done for speeding at 35 instead of 30. He insists that he wasn't speeding, cos he watched the speedo at 30 as he went through. Now he has been told there is a sixty quid fine, and three points on his licence. He is adamant that he wasnt speeding, and is wondering if he will have to pay the fine or if work will pay. Nothing can be done about the points to go on his licence, but I am flipping furious :mad: . He isnt employed as a driver, but does it to help 'em out when work is slack. He thinks the speedo on the van must be wrong, but the depot say that its fine! He knows he watched the speedo saying 30, so something is wrong somewhere. Can he appeal against it, and should work pay the fine? It's a lot of money out of what is a very low wage.

    Appeal the ticket, ask when the camera was last serviced, no doubt the ticket will have been issued to the council and not directly to him?

    Thanks for that! How would he appeal the ticket? And find out about when the camera was last serviced etc. Lots of them around us get burnt out pretty often. I am so angry because he knows he wasn't doing more than 30, but how does he prove it? It's so frustrating!!!

    Unfortunately the penalty is for the driver, therefore your OH is liable for the fine not the company. Also, I think the company would be acting illegally in reimbursing a fixed penalty charge?

    If he is sure he was not speeding, then his best bet would be to challenge the ticket. There is a website that helps you do this- I don't have it to hand but if you go to the travel thread on here I think you'll find it there.

    Just a quick update, when hubby got into work today, they went through the records and it wasn't him driving, it was his mate! The fine was on the day before they thought, so now he knows he's not losing his marbles!!! His mate is not happy though!
