Possible Tax Refund after discharge

Hi all,

I wonder if I get some clarification please; I got discharged on 19th Feb 2019 and I think I may be due a tax refund because when I did a salary calculator it states how much tax I should be paying, however since last April my pay slips show a higher amount, about £25ish more to that figure.

Now I may be totally wrong but to me, that says I've been overpaying on my tax.

When I went Bankrupt my tax code 17/18 wasn't changed as it should have for the rest of the year and a few months later I had a letter to state I had overpaid and that they sent the amount to the OR.

So the question is if I am right and come to the end of the tax year I get a letter from HMRC to state this, or if I call them to query it, I assume the refund would go to the OR as I was still Bankrupt during the overpayment period??

    Have you had a word with your employer to ask why the calculations are different? Payroll in any company is the only department which should have zero errors.

    I have my boss has told me he's entered the tax code as per what was sent to him by HMRC.

    That is not the standard code. Did you get a notice of coding showing how this was made up.

    Does your employer provide any taxable benefits?

    Nope, I never got anything and no I get no taxable benefits. My employer is a friend of mine who I've known for some time, he's aware of my financial situation and is transparent with everything.

    I'm a bit confused as to why I've been paying more tax back, but am I right in saying that if I do get a tax relief that I'll have to give it to the OR?

    You need to find out why your tax code has been reduced by phoning HMRC.

    As to who gets any potential refund, I am not 100% sure if this will be offered to OR first.

    I've just logged into my HMRC online and can see they have my tax code as 1179L but it's definitely 1077L on my payslip, so it may be a typo will confirm with my boss.

    Online there's a taxable benefit of £54 for 'Other' which I'm unsure what it is tbh, again will ask my boss.

    EDIT:

    Just to add, I've spoken to my boss and he states the Tax Code is correct, so I'm clearly overpaying and confirmed the 'Other' company benefit is Health Insurance.

    Now the question is to confirm if the OR gets the refund or me.

    Naaa you wont be entailed to any refund as it would be considered an asset of the bankruptcy.
  • I have just spoken to HMRC and they've clarified that my tax code was changed back in Jan 2018 and the code was sent to my employer, however, it appears my employer didn't get this and therefore I've been paying too much tax for just over a year now. They've sent the information out to them again and advised that if it's put through before the end of the year then I'll get it back in my wages, otherwise it'll be done when I get my P60.

    I've just called the insolvency dept but as I'm discharged I can't speak to anyone but I've been advised to send an email across instead, so just waiting for confirmation on what will happen; obviously, I'm expecting it'll be going straight to the OR but just need clarification as the period before I went BR and after should come back to me??
