Capital One..eligibility?

Sent first letter to Capital One reclaiming PPI under the "fined by the FSA route for failing to treat customers fairly", received a letter back saying I was NOT one of those customers and this had no bearing on the sale of PPI to my account. However further down in the letter it says
"although PPI was added to your account from your request (online) I notice your income stated on your application suggests you werent earning enough to be paying National Insurance. this would affect your eligibility so please send confirmation of your NI status at the time PPI was sold and I`ll review the premiums charged".

Firstly, I DO think it was mis-sold to me as from what letter is saying is that I would not have been eligible to claim if I needed to. Is that right??
So the person dealing with my request would have SAW my income and STILL went ahead selling me a policy that they KNEW wasnt any good. Surely that is treating a customer unfairly?
Regarding PROVING what my NI staus was at that time, should it be up to me to send a copy of my p60 for ? They went ahead with issuing me with a cc and a policy on the basis of what little I earned. Is there any point continuing? We are only talking approx £200 anyway. Thanks in advance.

  • Hi Peter, Im presuming Capital One provides it? It does not mention any other company on the letter returned to me. Obviously it will be on the forms sent to me at time when I received my card. Will have to dig them out. Thank you for replying.

    Hi
    Write to Capital One requesting the terms and conditions of the payment protection. This will tell you who actually provides the cover. It is highly unlikely to be Capital One themselves. Then once you have the information and it is confirmed that Capital One have introduced a third party to your agreement we can have a little fun with them.

  • Trouble is the letter states that if I dont get back to them within four weeks they will presume I am happy to leave it at that. Would they tell me over the phone? Save a bit of time writing back and forth isnt it? Thank you

    Try giving them a call. Ask them who underwrites their payment protection
    See how you get on. Failing that put it in writing.

  • Phoned Capital One and when I asked who underwrites their payment protection I got put through to "Ian" in specialist accounts (or something), he said that premiums have NOT been cancelled, I told him of the letter I received and he said he didnt know anything about it!! Told him the name at bottom of letter and content and he said eligilbility is from the last 6 months and so I WOULD be covered now because I am earning more than when I did at time of polcy taken. Told Me AXA is third party and it was MY fault that I asked for PPI and it was NOT capital one who sold it to me and I should have read t&c. Fair enough, but it wasnt me who put in that letter that my NI status at the time would have affected my claim if I need to make one!! Think Im fighting losing battle.
