Hi All,
I'm wondering if someone could give me some advice. Back in 2009 my wife took out car finance with CarCraft. The finance was made up of two loans, one secured against the car by Carlyle and an unsecure 'top up' loan by All In One Finance. In 2011 we went into some extremely bad times and she entered into a self managed DMP. The car was repossessed, etc. Anyway, as some of you will know CarCraft & All In One Finance went into administration, our debt was sold to PRA Group. At some point in 2016, we received a letter from PRA Group telling us that the debt had been written off and we stopped the payments. Fast forward to 2019 and my wife got a phone call from PRA Group demanding payment. Unfortunately we can't find this letter, but know for a fact that we received one - payments stopped in 2016, while other creditors payments carried on, plus we didn't receive anything further from PRA Group asking why the payments had stopped. We've done the CCA request and after a week or so, today we received a copy of the original agreement. At this point, I know that there's probably not much we can do and we will just have to pay the amount (at the end of the day we've lost the proof that the debt was written off), but just in case I thought I'd ask someone else's advice.

Unfortunatly if youve lost the letter, youve lost your evidence.
I would say with a degree of certainty that letter was probebly an error in any case, as they appear to have produced a compliant credit agreement.
You could send a subject access request to them, that will get you all the information they hold on you, maybe including a copy of that letter.

We turned the house upside down over the weekend trying to find the letter and stumbled upon an unopened letter from them from May 2017 saying that they had mistakenly told us that the debt was settled. We are going to send a SAR anyway, but I'm assuming that because we found this letter then the debt is still due. Its a bit off though that they can tell you that the debts written off and then a year later all of a sudden says its due again!0
