Hey all,
Bit of a quick question...
I'm scoping out an issue with a family member RE: unfair redundancy and I believe there may be a case (going to clarify with ACAS and union rep).
Basically, would a Full Time worker who has had a Part Time flexible working request approved and in place for over a year now (with >2 years continuous service), with no end date to it, be considered as "Part Time" in terms of any redundancy process?
What difference is this going to make? Part-time workers' rights in redundancy are the same as for "full-time".0 -
Try explaining the problem you think exists rather than skirting around the edges of part time full time.0

Indeed they are, which would potentially make treating a part-time worker less favourably as unlawful.
I just wanted to know if flexi request qualified them as a "part time" worker to be honest. I'm going to speak to the union rep/ACAS about whether there is a case or not.0 -
If they're not working full time hours then they're not full time. Whether they're flexi or not is neither here nor there, it is the number of hours worked per week and what that employer deems as full time.This is a system account and does not represent a real person. I appreciate that you want to know more, but in my experience I don't always think that MSE is a good place for advice on matters which have some element of contention. Luckily there is access to a union rep and ACAS too so that's where the info will be gained for the particulars.
