BR & Tax credits overpayment

Hi all

After some advice please.

Large tax credit overpayment for 2015/6 has been included in my BR. Was joint but husband declared BR April 2018 (have taken ages to save my fees)

We have been paying back at rate of 50% of weekly entitlement.

Am i right in thinking now we have both been approved as BR, they cant take this any more and i should recieve 100% of entitlement each week?

Do i need to call them or will this be automatic from the letter they receive from OR? if payments continue for a while due to backlog will i get them paid back from date of BR?

Thanks
L :o

To my knowledge overpayments are included so long as there is no fraud involved. If you were considered to have claimed the benefit fraudulently, they I don't believe it is included.
  • No fraud, thankfully. Just a genuine overpayment accrued over 2 tax years due to many changes during this time (mat leave, childcare, reduced hours, increased hours & husband lost job! No surprise it all resulted in overpayment to be honest!) Thank you :o
