    Ah a set aside hearing, sorry!

    IN THAT CASE you need to take evidence:

    - that the claim was never served to you, due to (what, the address being wrong?)
    - that you had no opportunity to defend
    - that you moved house /wrong address was being used (whatever is true?)
    - that this car is not yours!
    - that the Claimant assumed wrongly, and pursued you unlawfully, having neither obtained your data from the DVLA (registered keeper) nor had they had any admission of being the driver
    - take a printout of the POFA 2012 schedule 4 and point to what they should have done in order to pursue the keeper, who was not you
    - and ask that your £255 fee (if you paid it) be ordered against the Claimant for them to pay it and your travel costs for attending court to remove a rogue, not properly checked CCJ that didn't even relate to your car.

    Great thank you.
    How can I use POFA if the car is leased? To show that they didn’t contact the registered keeper to find out who the driver was?
    As far as evidence to show that they had an I correct address for me, is a copy of page of my credit report enough? I have no other way to prove that it was incorrectly served as I obviously never received any paperwork from them.
