Remortgage with non co operating ex

My 5 year fix is up later this year. However I'm going through a very lengthy divorce. My ex wife moved out of the house a few months back. However she so far in non cooperating on anything.

I wish to remortgage to a new lender, but can i do this if she's still on my existing mortgage deal? As if I go onto my lenders svr I'd be paying an additional £200-300 than nesscery.

I then expect to have too lend some more on my property once the finances are settled.

    Until the matter of the property is resolved. Your options are limited. Does your existing lender offer any options?

    In my experience the remortgage wasn't possible without my ex agreeing and signing off. I had gotten mortgage offer based on just my earnings and was ready to proceed. Might be an idea to seek legal advice. Good luck.

    Time to force a sale if she's not cooperating, need to consider getting a clean break unless there are children involved

    Can you not do an online switch to another product onto a cheaper tracker (than the SVR). This doesn't tie you in.
  • You have to recieve consent from to it ex via solicitors before she can be removed from the title deeds. The mortgage must also be affordable in your sole name. The first thing you need to establish is arguably affordability on your sole income. Next you need to get your ex to confirm she's happy with being removed from the title deeds. You will need to offer her some sort of pay out towards her share of the property. Please note when looking at affordability on the mortgage you will need to calculate in this settlement. For example your mortgage is currently 100k and you agree to buy out your ex with 30k. You need to check affordability with the lender on 130k. That's the most I can say with the limited information you've provided.
