More problems for me

Losing the will to live here :o

So, after advice on here and off the board, I contacted my council to inform them of my bankruptcy, tell them I was not liable for council tax this financial year, and ask for a refund of the money paid since my bankruptcy order (not expecting to get this, but I thought I might as well ask).

Result: A new bill demanding everything due to the end of March, payable tomorrow.

Any advice from anyone whose had the same problem?

No - not unless there has been a very recent change in the law that I missed?

Are you the only eligible person for CT at your address? If so - get a copy of your BR certificate and pop down to the council with it and tell them to check with their own solicitors. You wont get a refund...but you should not pay CT until the end of the current financial year.

Speak to your OR and ask if they will contact the council on your behalf and explain that you are bankrupt. You def do not have to pay it.

Quick update: I have had a letter from the council confirming that I do not have to pay council tax for the remainder of this financial year.
It would appear they are also going to refund the payments I have made since my BRO, but are contacting the IP to check if they can be paid to me. I am assuming they won't be, but I am fine with that.
  • That's good its another thing off your mind.

    The only problem
With that is though, if you do not have an IPA and council tax was included in your outgoings and then the OR gets wind of the new £100 surplus in your budget before the end of your bankruptcy you could end up with a 3 year IPA?! Is there any chance you can cal them and just say don’t worry about contacting them and you just have one month free and don’t poke the bear?!

I have heard back from the IP this morning that she has advised the overpayment be returned to me. Great news. Cloud, I am hoping that as the ongoing benefit only lasts until next month before I have to start paying again, that I will be OK re IPA. Fingers crossed though

Ahh great news! Fingers crossed they don’t bother to ask any more questions about it :)
