Starting a new job - time off for employment tribunal

So

Hoping someone can help advise here.

I'm due to start a new job soon, but have a date coming up in the not too distant future for an Employment Tribunal Hearing against a previous employer who dismissed me after I requested a temporary alteration in hours due to mental health issues.

However, I've been told the dates I've mentioned (I didn't mention it was for an ET) provide a problem with my new employer.

I'm not sure how best to proceed with this as I'm not sure how good an idea it would be to tell them what the dates are needed for, especially as there's obviously the chance the case could be settled without a need for the tribunal (although that looks unlikely due to the attitude to date from the respondent in my case).

Can you try to rearrange the date of the Employment Tribunal hearing? Better that and than to make life difficult for your new employer.
  • I'm not sure.

I'll contact my solicitor to see what they say...

    I agree.

I know it shouldn't be the case but sadly a lot of employers will not look favourably towards a new employee who is taking their previous employer to a tribunal. Compound that with insisting on time off when it is inconvenient to the new employer is not a good way to start!

If you were a witness in somebody else's case you could get a witness summons issued and your employer would have to allow you time off or risk being in contempt of court. I suppose you could do the same here but oh dear.....

    Not easy I'm afraid.

Nor had the common curtesy to thank anyone who posted advice on it - not that people have to but helps it paints a picture.

I wonder if they'll update us on the outcome of the tribunal.
