Agency told me I can't use holiday pay as sick?

I've been working for a agency for over 3 months in a office job.
I had 2 days.off work sick last week and asked the agency if I could use my accrued holiday pay for the days I was off .. there answer was 'you can't use holidays to cover sickness' ...I really needed the money as I was off sick over Xmas for a week and used no holidays

Does Anyone know agency workers rights with this ?
I was told by someone who works in employment disputes that the agency are wrong.

    You cant book holidays after youve had them.

    Sometimes they might allow it if youre a favourable employee, i suspect there arent many with regards to agencies as they cant be seen to favourite.

    If you want to be paid when youre sick and the company you work for does not have a more favourable sickness policy then you need to attend work.

    There is no "right" to this as far as I know (and certainly not in normal non agency employment). However employers frequently allow it as it costs them nothing as they would have had to pay the annual leave at some point.

    All you can do is ask.

    Are you full time?

    book holiday days on top of your normal hours to get accrued pay.

    Sounds like a bad agency, my employer even allows me to retroactively book off sick days as holiday.

    It's up to them unless your contract says you can.
  • When temping I had to request the holiday pay two weeks in advance so it would be paid the week I wanted it.

    Have a look at the T&C's relating to holiday pay / requests for holiday pay, the info should be there and you will see why you cannot claim it without any notice to them.
