I wanna do it but not sure if I’m in the right or not

So my dad got me in debt with a talk talk WiFi bill. He took it out in my name but he paid for it so all the bank details on the account are in his name. I received a phone call from Lowell, and they explained this debt to me. As you can imagine I was pretty upset that my own dad has it in him to get me into a large amount of debt. I decided to set up a direct debit of just £1 a month, (such a little amount as I was heavily pregnant and couldn’t afford much more and just wanted it to be sorted to settle my mind). My dad doesn’t seem interested that he’s got me into this pickle and isn’t willing to help me.

Anyhow, I’ve been speaking to a few friends and they have said to me that I can take further action, and they have said that because the payment details are all my dads details, I can take it further and the debt can go to him. I don’t know how true this is and I’m not sure where to find advice from for it so I’ve come here.

I just need some help please. I have a 6 week old son and I’m stressing about this debt.

Hi, we move threads if we think they’ll get more help elsewhere (please read the forum rule) so this post/thread has been moved to another board. If you have any questions about this policy please email forumteam@moneysavingexpert.com.

I’ve moved your thread from the ‘I wanna’ board to the ‘Debt-Free Wannabe’ board, where it is better suited.

    Regards

Regardless of who pays the bills, whoever agreed the contract with TT is the person who is responsible for paying the debt. Whose name is the contract in?

Don't agree even £1 a month until that has been established. If you took out the contract with TT then unfortunately you owe them the money. In the meantime, try to reduce the scope of the supply to a cheaper package. Don;t just cancel or you might find it difficult to get wifi and phone with somebody else in view of this debt.

It sounds as though you are alleging that he committed fraud. If so the company will expect you to report him to the police before they will entertain any thought of accepting that the debt is not yours.

Are you willing to do this?
  • I don't think you should acknowledge the debt by paying anything.

Do you mean your Dad took out the debt in his name but quoted your bank account details? Effectively it is the name on the contract who owes the money. If it is fraud then that is a criminal offence which needs reporting to the police if you are willing to do that. I should first of all write to Lowell to say this is not your debt, you did not take it out and don't acknowledge it.

Unless you signed up/agreed to this, you aren't liable. Refer the debt collectors to your father and he can sort it out.

You say he took it out in your name? I think you're going to be stuck with a tough decision to make here.

You either report it to Action Fraud as a criminal matter, then pass the case reference to the debt collection companies who should stop pursing the debt whilst the fraud investigation concludes or accept that you'll be paying the debt.

To be honest, there's not many details to go on...

Now this is acts as further evidence that there's not many details given to us. Are you currently still receiving service from TT and are you the one benefiting from it? It would be completely different thread if you were living at home with him using the WiFi...
