Probation has been extended with reasons too vague to act on

    I have been at my company five years, probation was 3 months and I never had a meeting regarding it or anything in writing about it.

    I do remember mentioning it to my boss at the time after about 4 months (probation was 3) that I hadn't had a meeting so had I passed? the reply was if there was no meeting I did.

    I am not sure if this is relevant to you as I don't know the law but if its six months maximum and you are still working there 6 months and one day, if must be assumed you have passed.
  • What is the approximate value of the benefits which you are being denied, through not having confirmation that you have passed probation?

    Does your manager understand that by extending your probationary period for her own convenience she is denying you these benefits? It might be worth explaining this to her in a friendly way, since she seems to have been clear that it's a 'not you, it's me' sort of situation.

  • thanks for all the suggestions guys, on my contract the probation is 3 months with possibility of extending up to a max of 6. At the end of my 3 months I agreed to extending by another 2 which brought it up to the 4th of Feb. My contract also states that probation finishing is confirmed with a letter, which I havent received. It's a small company and open plan, I've spoken to the head of HR after the renegotiated finishing date passed, she assured me it would be discussed the following day. Still nothing. There are some notable benefits when probation is 'officially' passed so I'm not happy with just letting this keep running.

    Normal legal position is that if you have passed the end date of your probation then you are deemed to have passed if it has not been extended or your employment terminated.

    So that's good news for you. But, as others have mentioned you are in a weak position in the sense that your employers could still let you go with little/no reason.

    Contractually though I would argue you are now entitled to any benefits that come with having passed probation, but its a judgement call for you on how much you push it.
