I think an employment tribunal and The Pensions Regulator might well become involved in such situations, and the employer would likely end up with a somewhat larger bill than they would by just giving their workers their legal rights in the first place.I am an Independent Financial Adviser. And you would have an extremely good case for wrongful dismissal. Companies should not be able to get away with breaking the law because of fear of employees losing their jobs.
Why do people get things blown up out of all proportion? The company (in keeping with so many others) has got it wrong. Just get it sorted out, quietly and diplomatically, rather than going OTT.Googling on your question might have been both quicker and easier, if you're only after simple facts rather than opinions!0 -

I agree with this. Pensions can be complicated and many HR people do not really understand them and have probably just not read the rules correctly.0
