Natwest gave husband 5 loans - can we claim for exploitation?

  • I’d have to agree with the others. You yourself had an IVA as you had debt that you could not service and that should have been enough of a learning experience to not have it happen again.

Banks are not your parents, or your carers, they are companies established for the purposes of making a profit, and they do this in part by lending money to apparently capable adults.

They have no interest in lending money to people who they believe won’t repay it, so they try to stay the right side of that line but they can’t tell how careful you will be to make sure that you never struggle.

  • Like last time OP was here about debt, I doubt they will respond or take advice.
  • I’m looking forward to the next instalment, “My son
gave all his money to a woman he met in a hotel bar, can I get compo?”

I've picked out a few points from your posts:

    - £22k plus £4.5k run up across 5 loans (and overdraft).

    - He takes home £3.2k a month and your outgoings are £2.9k. I'm going to give you the benefit of the doubt and assume you are working (so maybe £1k-£2k extra a month at least), but if you aren't then that's unsustainable.

    - You state " 5 loans PLUS and overdraft have been applied for and approved within a short space of time" which could either mean that the approval happened within a day or two (very unlikely you'd be making that point), or that multiple loans were taken out within a short space of time (likely).

Sort of suspecting gambling? Fits in with the narrative of getting lots of large loans in a short amount of time, the hiding of the loans (especially when YOU control the money and thus the loans presumably didn't get spent on the family unit?), the expensive lifestyle and finally the attempt to reclaim some money and transfer blame elsewhere.

I think that, sadly, your point is only valid in limited scenarios. Maybe, for example, your husband is permanently disabled in some way and/or incapable of entering into a credit agreement. In that case then YES, you've potentially got a case. But if he's just another ordinary stiff (and he totally is by virtue of being able to draw a £3.2k monthly wage) then tough luck. Ring up StepChange. And, if I'm right, kick his !!! into gear about the likes of Gamblers Anonymous etc.

You also need to cut down your expenditure big time. £2.9k, even with 3 kids, is insane! It's shocking.
  • Les catch up. OP is not exactly whiter than white! She came on here some time back about her debts and IVA. She didn’t come back then. No difference today!
