Can I move house whilst undischarged?

Hi all

I have searched the forum for similar situations but couldn't find specific answers I need; I would appreciate some advice please.

Am I able to move house whilst undischarged? I currently rent and would be moving into a rental. I can't find anything that states that I can't. However, I just want to check with forumites.
I am paying a NT IPA but as yet no other IPA (it still might happen though? I haven't heard anything about one yet). I am due to be discharged in July.
I understand I have to let my OR and Clarke Willmott know the new address.

    There is no restriction on you moving house. The OR and CW will of course need to informed of the new address. However, if the cost of the new rental are higher/lower you need to submit a new SoA and your IPA might change.
    If the OR has not set an IPA yet, I would assume its because you don't have sufficient 'surplus' to pay one?

    I didn't think so but needed to check here too for peace of mind.

    I didn't have a surplus in the SOA I sent and it wasn't discussed in my interview. I assume they agreed with my SOA but I was under the impression the OR could request an IPA anytime until discharge? In my head they may not have got to mine yet (short staffed like all depts?) so I check post daily still. Maybe irrational but it's the only way I will know it seems.

    Of course.
    Otherwise landlords would be stuck with you for 6 years, you couldn't get a job that required a change of location, you couldn't downsize to cheaper accommodation, etc.

    The OR can only set your 'surplus' IPA before discharge. Unless you send the OR a new SoA that shows a surplus to collect - I doubt you will get one out of the blue. However, moving is likely to prompt the OR to ask for a new SoA anyway.
  • When are you moving? Remember you have 21 days to inform the OR of a change in circumstances.

    In my experience, add on the 4 weeks for them to respond to your CoC... 2 weeks they give you to complete the new SOA... and then another few weeks for them to look at it. They may never reply. But by then you're discharged. If an IPA isn't signed by you before discharge, it can't apply.

    Think very carefully about timings if you think your new SOA may leave you open to a surplus IPA. Sometimes it's better not to poke the bear!

  • Just in case you didn't already know, it can be harder to get a rental house whilst bankrupt. I am undischarged and had to leave my previous rental on December 22nd and find a new place, it was quite tough as I kept failing agency credit checks and couldn't sort out a guarantor in time so ended up having to pay 6 months rent in advance. Hopefully you are sorted already, just wanted to mention it in case you weren't aware.
