Council tax -

Hello, I have lived in Wolverhampton, but moved out at one point and have cancelled the direct debit towards the council tax. I remember contacting the council, letting them know that i move out but i might be wrong. Therefore i have been contacted by bristow and sutor letting me know that i have to pay them for the council tax. I contacted the council tax and they had on their record that i moved out in September 21, but i actually moved out in august 3rd. I have proved that and they have agreed that they made a mistake but they still charged me for the summons costs and legal costs. I have overpaid the council tax with £67.31 but the legal costs are £71.50 so i still owe them £4.19. Should i just pay the balance and forget about them or i have a chance to recover the £67.31?

They probably had info such as a new tenant moving in on September 21st. Its not their fault you didn't inform them of the actual date. They have not admitted to making a mistake they are accepting your dates as opposed to the dates implied by the new tenant or even landlord/agent.

Did you not wonder why you had not got a closing bill to your new address?

The fees are correctly applied as you did not keep your account up to date and inform them of changes.

If everything was correctly incurred, as it appears to have been, then just pay the balance to clear it. Very unlikely the council will waive the costs where they are correct.
I no longer work in Council Tax Recovery but instead work as a specialist Council Tax paralegal assisting landlords and Council Tax payers with council tax disputes and valuation tribunals. My views are my own reading of the law and you should always check with the local authority in question.
  • Thank you Katrina,

Yes, i might have chosen the wrong words here, i remember doing something, or letting them know in one way, but cant remember for sure. I have moved in another area with another council, (worcestershire) and they know when i moved in. Well i dont know why the new tenant didnt told them the right date when they moved in(actually its the landlord, had a section 21 notice i believe) so the landlord moved back in. I had and have an online account and at the contact preferences i have selected email only, as i knew that i will not have access to the property/mail anymore.

So, your answer is to give up and just pay the balance ?
