DLA and Bankcruptcy
Hi,
I was just wondering as I have looked around the forum and could not the information I was looking for. My wife and I went bankrupt in April 2007. I start a job in June and therefore filled out an IPQ after 3 months of starting this job. My Wife is claim INCAP and DLA and has a Mobility Car under the used scheme (pay for the car for 3 years and it's yours to keep).
I would like to know if possible, whether they would exempt the DLA and INCAP from the SOA?
Any help would be most greatfu

Lots of people say that DLA is always exempt, but I've not managed to find any official info to that effect.
However, as with all benefits an IPA can't be based on these alone; even if there is surplus income beyond what is required to live. There needs to be significant non-benefit related income for an IPA to be made.

The only thing I could find is that your wife would not be subject of an IPA if her income is wholey made up of benefits.

I am assuming that you are worried that your I&E will leave you paying an IPA if they take your wives contribution to the household into account.

The "Insolvency Helpline" is NOT the official "Insolvency Service".
The Official "Insolvency Service" has a helpline on:
