Court order

I had a divorce court order by the court in Holborn in London - it was stamped January 2011.

The CMS has contacted me to say my ex has contacted them and asked them to recalculate. They said they can take over after a year and one day of the court ruling. I explained this was unfair as it was agreed in court. Circumstances have NOT changed.

In court, the judge knew the tax returns were wrong and based it on an average taxi driver (in 2011). My ex drives an extended luxury 9 seater.

The CMS used the fake tax returns and has halved the payments. I am hardly getting anything for two teenage boys. It looks like I have four weeks to contest it.

Please help. Can the CMS just make a January 2011 court agreement void?

  • Yes, they can, in respect of the child maintenance element.

    Did your solicitor not explain this to you at the time?
    I often use a tablet to post, so sometimes my posts will have random letters inserted, or entirely the wrong word if autocorrect is trying to wind me up. Hopefully you'll still know what I mean.
