Age Old Debt Moved Address

Hi


Please could someone advise? I have 2 very old marital debts from 2009, both to the same company, both now removed from my credit file.


I ceased paying anything toward in December 2016 for both.



I wrote a long while ago for CCA for one account, they wrote back they can't find one :T. The other account I let drift, as they did.


I have since moved house this year. They continue to send letters/statements/debt collectors letters, to my old address for which I have post redirected....for the time being.




Do I write to tell them I have moved, most importantly will this interfere with my Statute Barred timeline? Or do I just write asking for the CCA for this final account (obviously with my new address on) ?





(Im finding the post redirection hit and miss, sometimes letters have ended up at my old address :embarasse ...and I can't redirect forever in any sense)

    If it were me, I would wait for them to send a letter direct to my current address before I were to act. Once they write to you at the correct address, then I would send off the CCA requests.


    You do realise the accounts cannot become SB before December 2022? There is also a chance that they may seek the enforcement route via CCJ (although this is a lengthy process)

    Best you lay your cards on the table to avoid a CCJ by default.
    Creditors only need write to your last known address, its quite common for people in your position to get judgements they knew nothing about.



    Write to creditor (1) telling them your not paying due to lack of compliant credit agreement.


    Send CCA to creditor (2) and update your address.


    Next step depends on the result you get.

  • Thank you Willing2Learn. I realise SB is 6 years from date of last payment, so 3 1/2 yrs to go. Unfortunately these 2 accounts have been a royal pain. It took 2 long years to get them off my credit file, FOS, etc, etc and huge amounts of correspondence as you can imagine. I rather suspect they would have gone for it by now, but I may be proved wrong.



    This is especially why I dont want to miss anything too, they have lied to the max in the past, obviously I dont trust them. I gather in order to enforce via CCJ, they would first have to produce the CCA?
  • Thank you Sourcrates, this sounds a sensible route, at least then I will have covered myself either way. Lets hope they write back and cant find this one either.
  • I'm currently going through asking the courts to set aside a CCJ by default, as papers were served at my old address. It's a complete faff and I'm annoyed I missed it originally.

    For the faff and stress of applying for the set aside, I would recommend updating your address.
