My wife and i are really struggling and are thinking of applying to be made bankrupt. I'm struggling with various health problems and my wife and I have recently had marriage trouble because of our financial situation. The question I have is we have 5 grown children and between them they have booked a holiday abroad for my wife and I for Christmas. Are we permitted to travel and take this holiday if we proceed with our application for bankruptcy?

What he's trying to say is did any funny business go on eg here you son/daughter here's £5k wink wink nudge nudge, then they go and book a holiday with said money.0 -
No ones making fun.
Here's a possible scenario.
You haven't gone bankrupt yet.
You have £15k in the bank, in a car, a flash Rolex, combination of all, whatever. Cash in it in.
You give the £15k to your 5 relatives. Maybe as cash, maybe as fake payment for something spurious so it looks real. Perhaps you say you are repaying old loans to them. Whatever.
Now you go bankrupt.
The relatives buy all of you together a holiday for £15k. Which you've really paid for but it doesn't look like that.
Thats the sort of thing I and others was referring to.0 -
Ok sorry if I was abrupt. No we have no money we don't own a car( I have a mobility car as I'm registered disabled) . I don't work and haven't done for a while but my wife works. Nothing underhand just a genuine question about wether it is ok to go on a holiday that the 5 children are paying for or wether we can't. If we can't I don't and have to cancel I don't want them to lose money. Like I said originally we've had a very difficult year with my health and our marriage.0

Hi Jimmy. So long as your children have truly clubbed together to pay for a holiday with their own money then there is no reason for you not to take that holiday,bankrupt or not. They sound like a nice bunch of kids who can see that you have problems and want you to have a break. What a lovely Christmas present.0

They are still paying for it at the end of January, February, March,April and May.
The reason I originally asked was I was worried if there were some law against it.
Also we haven't as of yet applied to become bankrupt but have been advised to do so by Step Change. We are currently in contact with our creditors and have began paying what we can to them.
I'm asking a lot of questions because I'm not very good at any of this.0
