Help with Judgement for Claimant!

Hi guys, in a real panic here!

I have a crappy ex boyfriend from 4 years back. He helped me out with some rent payments as he was planning to move in and had been staying a few times a week.

After a nasty split, he demanded this money back and I refused. This wasn’t a loan, there was no agreement in place and it was to his potential benefit too.

Long story short, I’ve just opened a judgment for claimant letter demanding I pay him this back and that I failed to respond to the original letter. I haven’t received an original letter! Am I screwed or is there anything I can do! It’s come as a total bolt out of the blue!

    assuming you havent received original paperwork, the court has found in his favour (presumably) because you didnt attend the hearing or put in a defence

    you can apply to set aside the CCJ, but this will cost you a fee. you need to complete N244 form.

    If you don’t pay it, he can further enforce the judgement by use of bailiffs, should he choose.

    Set aside may be an option.

    Trying to look at this from both sides, I can also see why he'd have an issue (it's irrelevant he was 'planning on moving in'), I wouldn't be best impressed if I was effectively paying rent to my partner when I visit her and the response of "ha ha! There is no contractual agreement between us, thanks for paying my rent suckaaahhh!!" would have fuelling him enough to actually go to court over it.

    What is the disputed amount out of curiosity? I'm assuming we're not just talking hundreds of pounds...

    As said above, you can fill out a N244 to apply to set this aside, there is a fee of £255 for this. If a judge has ruled in your ex's favour despite there not being a formal agreement, I would prepare as many different defences as possible (such as other possible uses for the money?).

  • If you believe you don't owe it, then you must have thought that the 'help' with your rent was a gift. I think that's a bit of a stretch to be honest. You owe him, and deep down you know it.
