Csa arrears while out of work

Hi all
Does anyone know where I can get help with this.
So I have been paying off Csa arrears of 20k at £310 a month deduction of earnings, I now owe around 9k however I have just received a statement showing what money I should of been paying each week. My issue is that between 2009 and 2014 I was unemployed and was part of my wife’s tax credit claim but the amount of money the csa expected me to pay each week was between £35 and £80 which is clearly more than I had coming in at one point I had a part time job earning 200 a month and the total the Csa asked for was 266 a month .i have calculated that they have over charged me around 7k. And I just don’t know where to start to get this sorted I would be greatful for any help or advise on this

  • Did you tell them about these changes to your circumstances st the time? If not, there is no mechanism for them to go back and recalculate your maintenance now.

    If you did, start by making a right of access request for a copy of your records, and then highlight to them from your copy of the records when it was you notified them about the change(s). If they’ve not acted on past notifications, they should go back and deal with it now (assuming they didn’t reject your requests at the time - for example because they asked for evidence from you and didn’t receive it).
    I often use a tablet to post, so sometimes my posts will have random letters inserted, or entirely the wrong word if autocorrect is trying to wind me up. Hopefully you'll still know what I mean.
  • I notified them as soon as I lost my job and explained that I was now working part time only earning 200 a month since that day I had no contact with them until the cms took over,when I tried to explain to the lady on the phone she said we had you as working
  • Make a right of access request for your CSA records then. They should show when you called and what happened as a result.

    You can then send copies of the relevant bits to CMS and ask them to look again at the arrears figure.
