Help needed - separating with a joint mortgage

Husband left a couple of weeks ago, we have a joint mortgage but because he is no longer living in the house he says he is no longer liable to pay it. Is this right?

We have 2 small children and I am unable to work due to a long term illness.

    If you have a joint mortgage, then he his jointly liable for that mortgage.

    I think you should go straight to your local CAB and get some help with this, because it looks like you will need their assistance to deal with your ex and the lender

  • With two chlidren he should pay 20% of his net income according to the CSA. Would that cover the mortgage?

  • He is VERY liable to pay the mortgage. My ex husband tried this on with me. Eventually we sold up anyway, but until that day he IS responsible

    You need to speak to CAB, and you need to speak to a solicitor (you might be entitled to legal aid), you also need to get onto CSA if he is not paying for the children

  • He is trying to scare you, he is jointly liable for the mortgage and if he thinks he will be able to get you out of the house he has another think coming! speak to the lender asap, if you can get them on your side your in an even stronger position. then straight to CAB, make sure you know your rights. good luck.
